ONLINE STORE REGULATIONS OF THE CASTLE OF FLAVOR
These Regulations define the general terms, rules, and methods of sales conducted by The Castle of Flavor limited liability company via its online store.
The activity is carried out in accordance with applicable laws, including consumer protection and data protection regulations.

DEFINITIONS
- Business Days – means the days of the week from Monday to Friday, excluding public holidays.
- Delivery – means an additional service provided by the Seller, consisting of delivering the ordered Goods to the Customer via a Delivery Service Provider using reputable courier companies operating within the European Union within the Schengen Area.
- Password – means a string of letters, numbers, or other characters selected by the Customer during Registration in the Online Store, used to secure access to the Customer’s Account.
- Customer – means the entity for whom, in accordance with these Regulations and applicable law, electronic services can be provided or with whom a Sales Agreement can be concluded.
- Consumer – means a natural person who enters into a legal transaction with an entrepreneur that is not directly related to their business or professional activity.
- Customer Account – means a personalized panel for each Customer, launched on their behalf by the Seller after the Customer completes the Registration process and enters into an agreement for the service of “Operating the Customer Account.”
- Entrepreneur – means a natural person, legal entity, or organizational unit without legal personality, which, by law, is granted legal capacity and operates a business or professional activity in their own name, entering into a legal transaction directly related to that business or professional activity.
- Entrepreneur with Consumer Rights – refers to a natural person entering into a Sales Agreement directly related to their business, but where the Sales Agreement indicates that it does not have a professional character for this Entrepreneur, particularly resulting from the subject of their business activity, as disclosed based on the regulations of the Central Registration and Information on Economic Activity (CEIDG).
- Personal Collection Point – refers to the location designated for serving Customers, located at Bastion Smaku Sp. z o.o., Ruś 2, 10-687 Olsztyn.
- Regulations – means these regulations.
- Registration – means the factual action performed in accordance with these Regulations, required for the Customer to use all functionalities of the Online Store.
- Seller – means Bastion Smaku Sp. z o.o., with its registered office at Ruś 2, 10-687 Olsztyn, registered under KRS number 0000632922, who is also the owner of the Online Store.
Online Store Website – refers to the websites under which the Seller operates the Online Store, available at the domain names bastionsmaku.pl, bastionsmaku.com, castleflavor.com. - Goods – means a product presented by the Seller via the Online Store Website, which can be the subject of a Sales Agreement.
- Sales Agreement – means a sales contract concluded remotely, on the terms set out in the Regulations, between the Customer and the Seller.
GENERAL PROVISIONS AND USE OF THE ONLINE STORE
- All rights to the Online Store, including intellectual property rights to its name, domain name, Online Store Website, as well as designs, forms, and logos posted on the Online Store Website, belong to the Seller, and their use may occur only in the manner specified and in accordance with these Regulations or with the Seller’s written consent.
- The Seller will strive to make the use of the Online Store possible for Internet users using all popular web browsers, operating systems, device types, and Internet connection types.
- The Seller uses the “cookies” mechanism, which, during the Customer’s use of the Online Store Website, is saved by the Seller’s server on the Customer’s device. The use of “cookies” is intended to ensure the proper functioning of the Online Store Website on the Customer’s devices.
- To place an order in the Online Store via the Online Store Website and to use services provided electronically via the Online Store Website, the Customer must have an active email account.
- To place an order by phone, the Customer must have an active phone number and an active email account.
- The Customer is prohibited from providing unlawful content and using the Online Store, the Online Store Website, or The Castle of Flavor’s Website in a manner contrary to the law, good morals, or infringing the personal rights of third parties.
- The Seller declares that the public nature of the Internet and the use of electronic services may involve the risk of unauthorized acquisition and modification of Customer data by unauthorized persons. Therefore, Customers should apply appropriate technical measures to minimize these risks. In particular, they should use antivirus software and protect their Internet identity. The Seller will never request the Customer to provide their Password in any form.
- It is not permissible to use the resources and functions of the Online Store to conduct business by the Customer that would infringe the Seller’s interests, i.e., advertising another entrepreneur or product; posting content unrelated to the Seller’s activity; or posting false or misleading information.
REGISTRATION
- To create a Customer Account, the Customer is required to complete a free Registration process.
- To register, the Customer must complete the registration form provided by the Seller on the Online Store Website. During the Registration process, the Customer creates an individual Password.
- During the completion of the registration form, the Customer has the opportunity to read the Regulations and must accept its content by marking the appropriate checkbox on the form.
- During the Registration, the Customer may voluntarily consent to the processing of their personal data for marketing purposes by checking the appropriate box in the registration form. In this case, the Seller will clearly inform about the purpose of collecting the Customer’s personal data and the known or anticipated recipients of that data.
- The Customer’s consent to the processing of their personal data for marketing purposes is not required for the conclusion of the agreement with the Seller for the provision of the “Customer Account Service.” Consent can be withdrawn at any time by submitting a relevant declaration to the Seller. The declaration can, for example, be sent to the Seller via email.
- After submitting the completed registration form, the Customer will immediately receive, by email, a confirmation of Registration from the Seller. At this point, the contract for the provision of the “Customer Account Service” by electronic means is concluded, and the Customer gains access to the Customer Account and can make changes to the data provided during Registration.
ORDERS
- The Customer may place orders in the Online Store via their Customer Account on the Online Store Website 24/7.
- When placing an order via the Online Store Website, the Customer selects the Goods they are interested in. Adding Goods to the order is done by selecting the “ADD TO CART” option under the item presented on the Online Store Website. After completing the entire order and indicating the method of Delivery and form of payment in the “CART,” the Customer places the order by sending the order form to the Seller. The Customer is informed about the total price for the selected Goods and Delivery, as well as any additional costs they must incur in connection with the Sales Agreement.
- The order summary will contain information about: the Seller’s identification details, the subject of the order, the unit and total price of the ordered Goods, including delivery costs, selected payment method, selected delivery method, delivery time, and delivery costs.
- To place an order, it is necessary to provide the required personal data in the order form, accept the content of the Regulations, and send the order by clicking the “Order and Pay” button.
- Sending the electronic order form by the Customer constitutes a binding declaration of intent to conclude a remote Sales Agreement under the terms specified in these Regulations.
- The Sales Agreement is considered concluded at the moment of the Seller’s acceptance of the electronic order form, confirmed by the display of a message confirming the order and providing its number.
- After concluding the Sales Agreement remotely, the Customer will receive a confirmation of the placed order by email, containing the confirmation of the order and final confirmation of all essential elements of the order and general conditions of the concluded remote Sales Agreement (Online Store Regulations), information about the Seller, Seller’s responsibility for the quality of performance, post-sale services provided by the Seller, and information on how and under what circumstances the Customer may withdraw from the agreement.
- In the event of order cancellation by the Customer, the Seller will refund the received payment within 3 business days. The refund will be made using the same payment method that the Customer used.
PAYMENTS
- The prices displayed on the Online Store’s Website for a given Product are gross prices and do not include information regarding Delivery costs or any other costs that the Customer will be required to bear in connection with the Sales Agreement. The final costs will be presented when selecting the Delivery method and placing the order. The Customer may make payments in Polish zloty (PLN) or in euros (EUR), depending on the currency chosen when placing the order.
- The Customer may choose the following payment methods for the ordered Goods:
- Bank transfer to the Seller’s account
- Online transfer via an external online payment system
- Credit card payment via an external online payment system
- BLIK payment via an external online payment system
- Visa Mobile payment via an external online payment system
- Apple Pay via an external online payment system
- Google Pay via an external online payment system
- Cash on delivery, paid to the Delivery Service Provider during Delivery
- Cash or card payment upon personal collection3. External online payment system providers include:

DELIVERY
- The Seller delivers within the European Union, within the Schengen Area.
- The Seller is obligated to deliver the Goods subject to the Sales Agreement free of physical and legal defects.
- The ordered Goods are delivered to the Customer via courier to the address provided in the order form.
- On the day of dispatch, the Customer will receive a confirmation of dispatch via email if personal collection was not selected.
- The Customer has the option to collect the ordered Goods personally at the Personal Collection Point. Collection can be made at the Personal Collection Point on Business Days during the hours indicated on the Online Store Website, after prior arrangement with the Seller by email or phone.
- If the Customer is not present at the address indicated at the time of delivery, the delivery service provider will leave a notification or attempt to contact the Customer by phone to arrange a time when the Customer will be available. If the ordered Goods are returned to the Online Store by the Delivery Service Provider, the Seller will contact the Customer by email or phone to arrange a new delivery date and cost.
COMPLAINTS
- The Seller ensures the delivery of Goods free from physical and legal defects.
- The non-compliance of the Goods with the contract should be reported no later than before the expiry date of the Goods.

- The Goods subject to complaint should be sent back to the address: Bastion Smaku Sp. z o.o., Ruś 2, 10-687 Olsztyn.
- The complaint notice should include at least: the Customer’s details, a description of the defect, the date of its occurrence, identification or disclosure, and the claims of the Customer as provided by law in case the complaint is justified. If the complaint notice is incomplete, the Seller is entitled to request its completion.
- In the event of a defect, the Customer may request: replacement of the Goods with those free from defects, a price reduction, or withdrawal from the contract in the case of a significant defect.
- The Seller will respond to the complaint regarding the Goods or the complaint related to the execution of the Sales Agreement within 14 days from the date of its submission by the Customer.
- In the event of withdrawal from the contract, payments made by the Customer, including the costs of delivering the Goods, will be refunded promptly, but no later than within 14 days from the date of receipt of the Customer’s declaration. The refund will be made according to the method chosen by the Customer in the declaration, or in the same way as the payment was made.
WARRANTY
- The Seller ensures Delivery of Goods free from physical and legal defects. The Seller is responsible to the Customer if the Goods have physical or legal defects (warranty).

- The claimed Goods should be sent to the following address: Bastion Smaku Sp. z o.o., Ruś 2, 10-687 Olsztyn.
- In the event of a defect, you may request an exchange for a defect-free item, a price reduction, or withdraw from the contract in the case of a significant defect.
- The Seller will respond to the Customer’s complaint within 14 days of receiving the complaint request.
WITHDRAWAL FROM THE SALES AGREEMENT
- If you are a consumer, you have the right to withdraw from a remote contract without giving a reason.

- The returned item should be sent to us immediately to the following address: Bastion Smaku Sp. z o.o., Ruś 2, 10-687 Olsztyn, but no later than 14 days from the date of your withdrawal from the contract.
- The withdrawal period is 14 calendar days and starts from the day the item is received by you or a third party designated by you, other than the carrier.
- Any payments you have made, including the cost of delivering the goods, will be refunded promptly, but no later than within 14 days from the day we receive your declaration of withdrawal from the contract. The refund will be made in the form specified in your declaration or in the same form as the original payment.
- We may withhold the refund until we have received the item back or until you have provided proof of its return, whichever occurs first.
- Please note that the right to withdraw from a remote contract does not apply to a contract where the subject of the service is an item delivered in sealed packaging that cannot be returned after opening due to health protection or hygiene reasons, if the packaging was opened after delivery.
SELLER’S REFUSAL TO FULFILL AN ORDER
The Castle of Flavor reserves the right to refuse an order if:
- There are difficulties in contacting the Customer.
- There are outstanding payments between the Customer and the Seller.
- The Customer does not comply with the rules of the Regulations.
SALES DOCUMENT
- A sales document in the form of a receipt is included with the order. Upon the Customer’s request, a VAT invoice will be issued.
- The sales document includes the items delivered in the order.
- The Customer authorizes Bastion Smaku Sp. z o.o. to issue VAT invoices without the recipient’s signature.
- To receive a VAT invoice, the Customer must provide the company name and NIP (tax identification number) in the order form.
REVIEWS
- You may submit a review about the service or the Goods on the Online Store during your visit by clicking on the interface attached to the product. Submitting a review is voluntary and free of charge.
- In the review, the Customer can rate the Goods with a rating from 1 to 5 stars and add a textual comment limited to 65,535 characters.
- Reviews are stored and displayed publicly on the Online Store Website.
- The Seller verifies reviews via the email address used in the purchase process of the Goods. If there is no confirmation of purchase, the review may be removed.
- The Seller may post reviews of the same Goods from their other online stores.
- The Seller does not modify reviews regarding content or the awarded star ratings.
- The Customer is solely responsible for their review. The Seller is entitled to remove a review in accordance with the law and these Regulations.
- It is prohibited to post content containing false or misleading information, vulgar, aggressive, offensive, or clearly contrary to good manners. It is also prohibited to post content that is unlawful, infringes on the rights of third parties, or constitutes unfair competition.
- The Customer agrees not to post content containing links to external websites, promotional or advertising content, or personal data of third parties.
- Upon the Customer’s explicit request, the content of the review may be hidden from other Online Store users, but the star rating will still count toward the overall rating of the Store and Goods.
DATA PROTECTION
- The rules for the protection of personal data are detailed in the Privacy Policy.
FINAL PROVISIONS
- Obligation to Provide True Information
- The Customer using The Castle of Flavor’s services agrees not to provide unlawful or false content.
- Orders containing such content will not be processed. The Castle of Flavor is not responsible for providing such content.
2. Email Delivery
- The Castle of Flavor is not responsible for the non-delivery of emails sent to the email address provided by the Customer if this is caused by the blocking or deletion of emails by software installed on the Customer’s device or by the blocking of emails by email server administrators.
3. Refunds
- In the event of the Seller’s refusal to fulfill an order in accordance with the provisions of these Regulations or in the case of cancellation by the Customer of a previously paid order, The Castle of Flavor will issue a full refund to the account specified by the Customer via email.
4. Personal Data
- By registering at https://bastionsmaku.pl/, the Customer agrees to the processing of their personal data by Bastion Smaku Sp. z o.o. to the extent necessary to fulfill orders and communicate with the Customer.
- The Data Controller is Bastion Smaku Sp. z o.o., and personal data is protected according to the Law of August 29, 1997, “On the Protection of Personal Data” (Journal of Laws No. 133, item 883), ensuring that personal data is protected to prevent unauthorized access by third parties.
- Personal data is stored in a form that allows the identification of the individuals concerned no longer than necessary to achieve the purpose of processing.
- Individuals whose data is stored have the right to access their data and correct it.
- If the Customer’s data does not reflect the actual state, the Customer may correct it themselves on the https://bastionsmaku.pl/ website after logging in. The Customer may request the deletion of their personal data by sending such a request from the email account provided during registration. Bastion Smaku Sp. z o.o. reserves the right to verify the authenticity of such requests via phone.
- The Customer agrees to receive emails directly related to the execution of the order placed by the Customer and technical changes to their account.
- Bastion Smaku Sp. z o.o. will never send emails requesting verification of customer data or re-registration on https://bastionsmaku.pl/ via a link provided in the message. Bastion Smaku Sp. z o.o. is not responsible for the consequences of providing Customer data on websites imitating the https://bastionsmaku.pl/ website.
5. Changes to the Regulations
- In the event of changes to these Regulations, The Castle of Flavor is not obligated to notify Customers of this fact.
- In the event of changes to these Regulations that result in financial obligations for The Castle of Flavor’s Customers, they will be notified via email.
- These Regulations are effective from September 1, 2024.
